Apps made available through the App Store are licensed, not sold, to you. Your license to this app (the "Licensed Application") is subject to this agreement, unless a custom end user license agreement is provided by the application provider.

a. Scope of License

Licensor grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules. Unless an upgrade is accompanied by a different agreement, this Standard EULA also applies to content, materials, services, and updates related to the app.

b. Consent to Use of Data

You agree that Licensor may collect and use technical data and related information about your device, system and application software, and peripherals, as needed to provide updates, support, and other services related to the Licensed Application. Licensor may use this information in a form that does not personally identify you to improve products and provide services or technologies.

c. Termination

This Standard EULA is effective until terminated by you or Licensor. Your rights under this agreement terminate automatically if you fail to comply with any term.

d. External Services

The Licensed Application may enable access to Licensor and/or third-party services and websites ("External Services"). You use External Services at your sole risk. Licensor is not responsible for examining or evaluating third-party content or accuracy, and is not liable for third-party External Services.

e. No Warranty

You expressly acknowledge and agree that use of the Licensed Application is at your sole risk. To the maximum extent permitted by law, the Licensed Application and related services are provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind, whether express, implied, or statutory.

If the app or services prove defective, you assume the entire cost of all necessary servicing, repair, or correction. Some jurisdictions do not allow certain warranty exclusions, so these limitations may not apply to you.

f. Limitation of Liability

To the extent not prohibited by law, Licensor is not liable for personal injury or any incidental, special, indirect, or consequential damages, including loss of profits, loss of data, business interruption, or other commercial damages or losses arising from use of, or inability to use, the Licensed Application.

In no event, except as required by applicable law in cases involving personal injury, will Licensor's total liability exceed fifty U.S. dollars (USD $50.00).

g. Export Compliance

You may not use, export, or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the app was obtained. By using the app, you represent and warrant that you are not located in an embargoed country or on a restricted list, and you will not use the app for any prohibited purpose under U.S. law.

h. U.S. Government End Users

The Licensed Application and related documentation are "Commercial Items" consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," and are licensed to U.S. Government end users only with the rights provided under this agreement.

i. Governing Law and Dispute Resolution

Except where otherwise expressly provided, this agreement and the relationship between you and Apple are governed by the laws of the State of California (excluding conflict of law rules), and disputes are subject to the personal and exclusive jurisdiction of the courts in Santa Clara County, California.

If you are not a U.S. citizen, do not reside in the U.S., are not accessing services from the U.S., and are a citizen of specified countries listed in the Apple Standard EULA, governing law and forum may follow the corresponding local provisions stated there.
